Oakland Tenant Rights: Rent Control, Evictions (2026)
What is different for renters in Oakland compared with California state law: rent control, just cause for eviction, relocation payments and deposits. In plain English from official city sources.
Short answer
Oakland's Rent Adjustment Ordinance limits yearly increases in older buildings to 2.3% from August 1, 2026 to July 31, 2027 — far below the state cap. Almost all rentals, including newer buildings over 10 years old, need a 'just cause' to evict, and no-fault evictions require relocation money. No-fault evictions are also banned during the school year for households with school children or Oakland teachers.

- Yes: 2.3% cap (covered units)
- Just cause for eviction

Rent control in Oakland
- Who is covered
- Rent Adjustment Ordinance (OMC 8.22): most apartments in buildings built before January 1, 1983, plus owner-occupied duplexes and triplexes and SRO hotel rooms. Units built on or after January 1, 1983, most condos, single-family homes and Section 8/subsidized units have no Oakland rent cap (they usually still have eviction protection). Newer units may fall under the state cap (AB 1482).
- Allowed increase in 2026
- 2.3% for August 1, 2026 through July 31, 2027 (0.8% for August 2025 to July 2026). The rate is based on the regional Consumer Price Index and changes every August 1. One increase per 12 months, never earlier than 12 months after you moved in, with at least 30 days' written notice. Landlords may 'bank' unused increases (from January 1, 2026, for up to 5 years), but a banked increase can never be more than 3 times the current CPI (6.9% for 2026-27). No increase may exceed 5% plus local CPI or 10%, whichever is lower (8.8% for August 2026 to July 2027). A landlord cannot raise your rent if the unit is not registered with the Rent Adjustment Program (RAP) or if the owner is behind on Oakland business taxes, and every increase notice must include the RAP Notice.
- How to check if you are covered
- Call a RAP housing counselor at (510) 238-3721 (Monday to Thursday, 9:30 am to 4:30 pm) or email [email protected] to ask whether your unit is covered. You can challenge an illegal increase by filing a RAP petition within 180 days.

Just cause for eviction in Oakland
- The rule
- A landlord can end your tenancy only for one of the just causes listed in Oakland law: unpaid rent (only if you owe at least one month of HUD fair market rent), a serious lease violation after written warning, nuisance or disturbing others after warning, refusing lawful access, owner or close relative move-in, Ellis Act withdrawal, or substantial repairs that require you to move out. A lease ending, a sale or foreclosure, condo conversion, or your refusal to sign a new lease are not just causes. Since Measure V (2022) this covers units built after 1995 too, except ground-up new construction less than 10 years old. No-fault evictions cannot take effect during the Oakland Unified school year if your household includes a school-age child or an OUSD educator. A copy of every eviction notice must be filed with RAP within 10 days after it is served; failure to file is a defense in court.
Relocation payments in Oakland
- The rule
- If you are evicted for owner or relative move-in, the Ellis Act, condo conversion, or code-compliance work, the owner must pay relocation money per unit. For July 1, 2026 to June 30, 2027: $8,293.13 for a studio or 1-bedroom, $10,206.93 for a 2-bedroom, $12,599.18 for 3 or more bedrooms. Households with a lower-income, elderly or disabled tenant, or with minor children, get an extra $2,500 per unit. Temporary displacement for code repairs requires the owner to pay your actual temporary housing costs.
Security deposits in Oakland
Oakland has no deposit-interest rule; deposits do not earn interest. State law sets the deposit limit and return rules.
Repairs and complaints in Oakland
Report unsafe or unhealthy conditions to the City of Oakland's code enforcement (Planning and Building Department) through OAK 311. If your landlord cuts services or leaves code violations unfixed, you can file a RAP petition for a rent decrease. Free representation in RAP petition cases is available for tenants earning up to 100% of area median income.
Eviction protections in Oakland
No-fault evictions are barred during the school year for households with school children or OUSD educators. Owners behind on Oakland business taxes cannot evict for owner move-in or substantial repairs, and must attach their current Business Tax Certificate to any such notice. Every eviction notice must be filed with RAP within 10 days; a failure to file is a defense in court. Oakland has no citywide right to counsel, but the city lists free eviction defense services: Bay Area Legal Aid 800-551-5554, Centro Legal de la Raza 510-437-1554, East Bay Community Law Center 510-548-4040 ext. 201, Eviction Defense Center 510-452-4541, Legal Assistance for Seniors 510-832-3040. - Owners must register units and tenancy details in the city's rent registry every year; unregistered units cannot get rent increases.
- The Tenant Protection Ordinance bans harassment, such as cutting services or threatening you to make you move.
- Landlords can pass half of the yearly $137 RAP fee per unit on to you if they paid it on time.
