If you get an eviction notice
- Read it closely: the kind of notice, the amount, the dates and how it was delivered. Use the timeline below.
- Don't move out or stop paying because of a notice alone. Only a court can order an eviction; the notice is the first step.
- Get free legal help now. Legal aid and the court's self-help center can check whether the notice is valid.
- If you are served with court papers, respond by the deadline and go to every hearing. Missing one can mean losing by default.
- Keep copies of the notice, your lease, rent receipts, texts and photos.
Eviction in Oklahoma
- Notice for unpaid rent
- 5-day written notice demanding payment. If you don't pay within 5 days, the landlord may end the lease and file. The notice may be given before or after the landlord files the case.
- Notice for a lease violation
- 10 days to fix (cure) the problem: the notice must say the lease ends at least 15 days after you get it unless you fix it within 10 days. A second breach can lead to immediate termination with written notice. Criminal or drug activity, or harm to health and safety, can mean immediate termination.
- Ending a month-to-month tenancy
- At least 30 days' written notice by either side. Shorter-than-monthly tenancies: 7 days. The notice must be served personally, on a family member over 12, or by posting plus certified mail.
- Time to respond to an eviction lawsuit
