Security deposit in Oklahoma
- Limit
- No statewide limit.
- Deadline to return it
- You must ask for your deposit back in writing. The landlord must return what is left within 45 days after the tenancy ends, you give back possession, and you make that written demand. If you don't ask in writing within 6 months after the tenancy ends, you lose the deposit. No interest is owed.
- Itemized list
- Yes. Deductions must be itemized in a written statement delivered in person or by return-receipt mail. Receipts are not required by the law.
- What may be deducted
- Unpaid rent and damages the landlord suffered because you broke the lease or your duties under the Act (for example, damage you caused beyond normal use). You may not use the deposit as your last month's rent unless the lease allows it.
- Interest
- No. The deposit is returned without interest.
- Separate account
- Yes. The deposit must be kept in an escrow account for you at a federally insured bank in Oklahoma. Misusing it is a crime (up to 6 months in jail and a fine up to twice the amount).
- If the landlord keeps it wrongly
- You can sue to recover the deposit and any prepaid rent, plus other damages the Act allows. The statute does not set a double or triple penalty.
How to get your deposit back
- Before you move out, clean, take dated photos and video of every room, and return all keys.
- Give your landlord your new address in writing. In Oklahoma: the rule above says where the landlord sends the deposit.
- Wait for the deadline: You must ask for your deposit back in writing.
- If the money or an itemized list doesn't come, or the deductions are wrong, send a demand letter (below). Keep proof of mailing.
- If that doesn't work, sue in small claims court. Limit: $10,000. Small claims court in Oklahoma on Small Claims Map
Repairs in Oklahoma
- The landlord's duty
- The landlord must make all repairs needed to keep the unit fit and habitable; keep electrical, plumbing, heating, air-conditioning, appliances and elevators working; keep common areas clean and safe (not for single-family homes); provide trash containers (not for one- or two-family homes); and supply running water and reasonable hot water (unless separately metered or a single-family home). 41 O.S. § 118.
- How to ask for repairs
- Your rights only start after you give the landlord written notice of the problem. For serious health or safety problems, you can also give a written notice that the lease will end in at least 30 days unless the landlord fixes the problem within 14 days.
- Repair and deduct
- Allowed for repairs costing no more than one month's rent. Give the landlord written notice that you will fix the problem at the landlord's expense after 14 days. If the landlord does not fix it in 14 days (or faster in an emergency), you may have the work done properly, give the landlord an itemized bill, and deduct the actual, reasonable cost from rent. If the landlord fails to supply heat, water, hot water, electricity, gas or another essential service, after written notice you may buy it yourself and deduct the cost, sue, or move to substitute housing and stop paying rent for that time. 41 O.S. § 121.
- Withholding rent
- No general right to withhold rent. Use repair-and-deduct, or the essential-services remedies, after written notice. Otherwise you risk eviction after a 5-day notice.
- Law
- 41 O.S. §§ 118, 121
Landlord entry in Oklahoma
At least 1 day's notice, and entry only at reasonable times, except in an emergency or when notice is impracticable. The landlord may not use access to harass you. You may not unreasonably refuse entry for inspections, repairs or showings. 41 O.S. § 128.
Eviction in Oklahoma
- Notice for unpaid rent
- 5-day written notice demanding payment. If you don't pay within 5 days, the landlord may end the lease and file. The notice may be given before or after the landlord files the case.
- Notice for a lease violation
- 10 days to fix (cure) the problem: the notice must say the lease ends at least 15 days after you get it unless you fix it within 10 days. A second breach can lead to immediate termination with written notice. Criminal or drug activity, or harm to health and safety, can mean immediate termination.
- Ending a month-to-month tenancy
- At least 30 days' written notice by either side. Shorter-than-monthly tenancies: 7 days. The notice must be served personally, on a family member over 12, or by posting plus certified mail.
- Time to respond to an eviction lawsuit
- No written answer is required before trial. The summons sets a trial date 5 to 10 days after it is issued. Go to court on that date.
- Lockouts and utility shutoffs
- Yes. If a landlord wrongfully removes or locks you out, you can go to court to get back in, or end the lease, and recover up to twice the monthly rent or twice your actual damages, whichever is greater.
- Law
