Security deposit in Kentucky

Limit
no statewide limit
Deadline to return it
URLTA areas only. Kentucky sets no fixed number of days to return the deposit. When you move out, the landlord must inspect and make a written list of damage with estimated repair costs. You have the right to inspect and sign it or write down what you disagree with. If you owe no rent and are due a refund, the landlord must send a notice of the refund amount to your last known address. If you do not respond within 60 days of that notice, the landlord may keep the money. If you left without paying the last month's rent and did not ask for the deposit, the landlord may apply it to the debt after 30 days. Outside URLTA areas there is no deposit statute; your lease controls.
Itemized list
URLTA areas: yes. Before you pay the deposit, the landlord must give you a written list of existing damage with estimated repair costs, and at move-out a written list of damage with estimated repair costs. Both must be signed by both sides; if you disagree, write down which items you dispute and sign it. Receipts are not required by the statute.
What may be deducted
Unpaid rent and the cost of repairing damage beyond normal wear and tear that is on the move-out damage list. Other charges only if your lease allows them.
Interest
no
Separate account
URLTA areas: yes. The deposit must be kept in a bank account used only for deposits, at a regulated bank, and you must be told the bank and account number.
Move-in checklist
URLTA areas: yes. A signed move-in list of existing damage with estimated repair costs is required before you pay the deposit.
If the landlord keeps it wrongly
URLTA areas: if the landlord did not keep the deposit in a separate account and did not give you the move-in and move-out damage lists, the landlord may not keep any part of the deposit. You can sue in District Court (small claims) over items on the move-out list you disputed in writing. If you did not sign the list or write down what you disputed, you cannot recover under this law. No multiple damages.
Law
KRS 383.580

How to get your deposit back

  1. Before you move out, clean, take dated photos and video of every room, and return all keys.
  2. Give your landlord your new address in writing. In Kentucky: If you owe no rent and are due a refund, the landlord must send a notice of the refund amount to your last known address.
  3. Wait for the deadline: URLTA areas only.
  4. If the money or an itemized list doesn't come, or the deductions are wrong, send a demand letter (below). Keep proof of mailing.
  5. If that doesn't work, sue in small claims court. Limit: $2,500. Small claims court in Kentucky on Small Claims Map

Repairs in Kentucky

The landlord's duty
URLTA areas: the landlord must follow building and housing codes affecting health and safety, keep the home fit and habitable, keep common areas clean and safe, keep electrical, plumbing, heating, air-conditioning and appliances they supply working, and supply running water, reasonable hot water at all times and reasonable heat from October 1 to May 1 (KRS 383.595). Outside URLTA areas there is no general statewide habitability statute.
How to ask for repairs
URLTA areas: give the landlord a written notice describing the problem. For ending the lease: say the lease will end on a date at least 30 days after the landlord receives it if the problem is not fixed within 14 days. For repair-and-deduct: say you intend to fix it at the landlord's cost; the landlord has 14 days. Keep a copy and use certified mail.
Repair and deduct
URLTA areas only: allowed if the problem materially affects health and safety and the repair costs less than $100 or half a month's rent, whichever is more. Give written notice; if the landlord willfully fails to fix it within 14 days (or sooner in an emergency), you can have it fixed in a workmanlike way, pay in full, give the landlord an itemized statement, and deduct the cost from rent (KRS 383.635). If the landlord willfully cuts heat, water, hot water, electricity or gas, after written notice you may buy the service and deduct the cost, sue for reduced rental value, or move to substitute housing and not pay rent for that time (KRS 383.640). Not allowed if you or your guests caused the problem.
Withholding rent
not allowed as a general remedy; Kentucky has no rent escrow statute. URLTA areas allow only the specific repair-and-deduct and essential-services steps above, or ending the lease after notice (KRS 383.625).

Landlord entry in Kentucky

URLTA areas: at least 2 days' notice, at reasonable times, except in an emergency or when notice is impracticable. You may not unreasonably refuse entry for inspection, repairs or showings. The landlord may not use entry to harass you (KRS 383.615). Outside URLTA areas: no statute.

Eviction in Kentucky

Notice for unpaid rent
URLTA areas: a written 7-day notice to pay the rent or the lease will end (KRS 383.660(2)). Outside URLTA areas there is no statutory pay-or-quit notice; check your lease, and a tenancy without a lease generally needs one month's written notice (KRS 383.195).
Notice for a lease violation
URLTA areas: a written notice describing the violation, saying the lease will end on a date at least 14 days after you receive it unless you fix it (statute says fix within 15 days). A repeat of the same violation within 6 months allows termination on 14 days' notice with no chance to fix (KRS 383.660(1)).
Ending a month-to-month tenancy
URLTA areas: 30 days' written notice before a rent due date, for either side; week-to-week, 7 days (KRS 383.695). If you stay on after a written lease ends, either side can end that tenancy with 10 days' written notice, and the landlord needs no notice if you are more than 10 days late with rent (KRS 383.695(3)). Outside URLTA areas: one month's written notice from the landlord (KRS 383.195).
Time to respond to an eviction lawsuit
No written answer is required. The court sets a hearing (forcible detainer trial); the warrant must give you at least 3 days' notice of the trial (KRS 383.210). Go to the hearing. If the landlord wins, you have 7 days to move out or appeal.
Lockouts and utility shutoffs
Yes. The landlord must get a forcible detainer judgment from court; lockouts, utility shutoffs and removing belongings without it are not allowed. In URLTA areas, if the landlord unlawfully removes you or willfully cuts essential services, you can get back in or end the lease and recover up to 3 months' rent plus attorney's fees (KRS 383.655).

Rent increases and rent control in Kentucky

Notice of a rent increase
no statute; for month-to-month tenancies the landlord would generally need to give 30 days' notice to change terms (KRS 383.695 in URLTA areas). A rent increase in retaliation is banned in URLTA areas (KRS 383.705).
Rent control
No statewide rent control. Since March 6, 2024, cities and counties may not adopt any landlord-tenant ordinance that conflicts with state law (KRS 383.198).

Late fees in Kentucky

no statute

Retaliation in Kentucky

URLTA areas only: the landlord may not raise rent, cut services, or file or threaten eviction because you complained to a code agency, complained to the landlord about repairs, or joined a tenants' union. A complaint within 1 year before the landlord's action creates a presumption of retaliation (not if you complained after notice of a rent increase). You can use it as a defense and recover up to 3 months' rent plus attorney's fees. The landlord can still evict if you are behind on rent or caused the code violation (KRS 383.705).

Small claims court in Kentucky

Deposit disputes usually go to small claims court, where you don't need a lawyer.

Limit: $2,500.
