Security deposit in Wyoming
- Limit
- No statewide limit. The lease must say whether any part of the deposit is nonrefundable, and you must be told in writing when you pay it (W.S. 1-21-1207).
- Deadline to return it
- The landlord must deliver or mail the rest of your deposit and any prepaid rent, with a written itemized list of deductions and reasons, within 30 days after the rental agreement ends or within 15 days after getting your new mailing address, whichever is later. If there is damage to the unit, the landlord gets 30 more days. You must tell the landlord, within 30 days after the rental ends, where to send it. A separate utilities deposit must be refunded within 10 days after you show all utility bills are paid.
- Itemized list
- Yes, a written itemization of deductions with the reasons. Receipts are not required by the law.
- What may be deducted
- Unpaid rent, damage beyond reasonable wear and tear, the cost to clean the unit back to its condition at the start of the lease, and other costs listed in the lease.
- Interest
- No. The law says the deposit is returned without interest.
- If the landlord keeps it wrongly
- If the landlord unreasonably fails to follow the deposit rules, you can recover the full deposit and court costs. There is no double or triple penalty. If you sue unreasonably and lose, the court can make you pay the landlord's court costs.
How to get your deposit back
- Before you move out, clean, take dated photos and video of every room, and return all keys.
- Give your landlord your new address in writing. - Wait for the deadline: The landlord must deliver or mail the rest of your deposit and any prepaid rent, with a written itemized list of deductions and reasons, within 30 days after the rental agreement ends or within 15 days after getting your new mailing address, whichever is later.
- If the money or an itemized list doesn't come, or the deductions are wrong, send a demand letter (below). Keep proof of mailing.
- If that doesn't work, sue in small claims court. Limit: $6,000. Small claims court in Wyoming on Small Claims Map
Repairs in Wyoming
- The landlord's duty
- The landlord must keep the unit safe, sanitary and fit to live in, with working electrical, heating and plumbing and hot and cold running water (unless you both agree otherwise in writing), keep common areas sanitary and reasonably safe, and maintain appliances promised in the lease. The law covers only problems that materially affect your health or safety. Duties can be changed by an explicit signed written agreement. W.S. 1-21-1202, 1-21-1203.
- How to ask for repairs
- Step 1: If you are current on rent, give the landlord written notice of the health or safety problem and the repair you want, by certified mail or by hand delivery as the eviction-notice statute allows. The landlord must, within a reasonable time, start repairs or tell you in writing that it disputes your claim (or may end the lease with 10 to 20 days' notice if repairs would cost too much). Step 2: If nothing happens, serve a 'notice to repair or correct condition' giving 3 days to start repairs. Step 3: File in circuit court; the court can order repairs, end the lease, and award damages including rent improperly collected. W.S. 1-21-1203, 1-21-1206.
- Repair and deduct
- No statute. Wyoming law does not give a repair-and-deduct right.
- Withholding rent
- Not allowed. Your repair rights apply only if you are current on all payments. The remedy is a court case (see how to ask for repairs, below).

Eviction in Wyoming
- Notice for unpaid rent
- A written notice to quit at least 3 days before the landlord files, left with you or at your home or business. An eviction may be filed when rent is unpaid 3 days after it is due. W.S. 1-21-1002, 1-21-1003.
- Notice for a lease violation
- The same 3-day notice to quit applies to lease violations and breaking your duties under the Act. No cure period is required by statute.
- Ending a month-to-month tenancy
- No statute found. Check your lease; the eviction law covers 'tenants holding over their terms.'
- Time to respond to an eviction lawsuit
- No written answer is required. You must be served 3 to 12 days before the trial date, and the case is tried on that day even if you don't come. You may file an optional written answer (court form available). Continuances are limited to 2 days unless you post a bond. If you lose, you may have to leave between 5 p.m. that day and 30 days later. To stop the eviction on appeal you must file a bond within 48 hours. W.S. 1-21-1004 to 1-21-1014.
