If you get an eviction notice
- Read it closely: the kind of notice, the amount, the dates and how it was delivered. Use the timeline below.
- Don't move out or stop paying because of a notice alone. Only a court can order an eviction; the notice is the first step.
- Get free legal help now. Legal aid and the court's self-help center can check whether the notice is valid.
- If you are served with court papers, respond by the deadline and go to every hearing. Missing one can mean losing by default.
- Keep copies of the notice, your lease, rent receipts, texts and photos.
Eviction in Nevada
- Notice for unpaid rent
- 7-day notice to pay rent or quit (summary eviction). You have until the close of business on the 7th judicial day after service; weekends and court holidays are not counted. For weekly tenancies of 45 days or less, the landlord may use a shorter notice ending at noon on the 4th full day. NRS 40.253.
- Notice for a lease violation
- 5-day notice to fix (cure) the lease violation or move out. If the violation cannot be fixed, no chance to cure. NRS 40.2516; NRS 118A.430.
- Ending a month-to-month tenancy
- Landlord: at least 30 days' written notice for month-to-month (7 days for week-to-week). If you are 60 or older or have a disability, you may ask in writing, with proof, for 30 more days. NRS 40.251. Tenant: the statute does not set a separate period for you, but a lease may not make you give a different notice of termination than the landlord must give (NRS 118A.220(1)(e)); giving 30 days in writing is the safe choice.
- Time to respond to an eviction lawsuit
- To stop a summary eviction you must file a Tenant's Affidavit (Answer) with the justice court before the close of business on the 7th judicial day after you were served with the pay-or-quit notice. If you do not, the landlord can ask the court for a lockout order, and the sheriff or constable can remove you 24 to 36 hours after posting the order. NRS 40.253.
- Lockouts and utility shutoffs

If the landlord locks you out, blocks your entry, or willfully cuts off an essential service, you can get back in, stop paying rent or end the lease, and recover actual damages plus up to $2,500 set by the court. Retaliation in Nevada
The landlord may not end or refuse to renew your tenancy, raise rent, cut services, or sue or threaten to sue for possession because you complained in good faith to a code agency, to the landlord or police about a violation of the landlord-tenant law, joined a tenants' union, raised habitability in a court case, or complained about housing discrimination, or because you are a victim of domestic violence. You get the lockout remedies (actual damages plus up to $2,500) and a defense to eviction. The statute sets no presumption period. Exceptions include a termination 'with cause' and rent increases applied equally to all tenants. NRS 118A.510.
